Social Security in the United States focuses on health care, help for the disadvantaged and those who are disabled and unable to work; these programs are all governed by Social Security law.

The law as it applies to disability:

For those that suffer from a physical or mental disability, Social Security law in Missouri sets the rules that decide who can qualify for benefits (SSDI or SSI) and, if they qualify, how much money they will receive while disabled.

SSDI (Social Security Disability Insurance) is for adults that have paid into the system through FICA and, due to their disability, cannot work for at least one year. Dependents of someone that is getting SSDI may qualify for benefits as well.

SSI (Supplemental Security Income) on the other hand serves a totally different purpose, this program focuses on those that are disabled and have little or no income; it is not based on having contributed to the system.

Requirements for benefits:

Social Security law in Missouri is very specific. For those claiming SSDI, the decision is based very much on the number of “work credits” the claimant has at the time. The law is strict; the claimant must have 40 credits, 10 of which must have been earned in the 10 years running up to the claim. The maximum number of credits that can be earned annually is four.

If the person is claiming for SSI the factor is income, not work credits. The applicant for SSI must not have an income that exceeds the FBR; Federal Benefit Rate. The 2017 FBR is $735 for an eligible applicant.
