Caveats of the Alabama Lemon Law

by | Aug 16, 2017 | Lawyers

Many people think that the Alabama lemon law is a powerful tool that they can automatically seek relief using. Unfortunately, most new car manufacturers and dealerships have teams of lawyers that are willing to fight back against these powerful laws. One of the best choices you can make is to ensure you do not battle unarmed. Hire an attorney that has experience making the courts enforce these laws. In many cases, the manufacturer and dealership will avoid fighting it out in court if you have a respected attorney representing you. Most times the manufacturer will back down when they know that an attorney is helping you with the matter.

Do Your Part

Any attorney will tell you regarding any case to make sure you document everything. It is especially true when you are dealing with the Alabama lemon law. You want to be able to build your case clearly, and one of the best ways to do that is to write down everything. Keep track of each encounter. Receipts, phone logs, and interactions should be kept safe.

The Caveats

There are a few caveats when it comes to the rather generous Alabama lemon law. One of the most unusual things about the lemon law in this state is that anyone that has a vehicle that is still under warranty is eligible to take advantage of the protection. This law may cover used vehicles if there is a warranty period left on the vehicle. Here are some down sides to the law:

  • The vehicle has had to be out of commission for more than 30 calendar days to seek repairs
  • At least 3 attempts and one final attempt to correct the problem has to be allotted to the dealer
  • Something in writing has to be presented to the dealer stating that a civil action is going to commence
